5. Legal Bases for Processing (GDPR)

If you are located in the European Economic Area (EEA) or the United Kingdom, we process your personal data on the following legal bases:

  • Contractual necessity — processing required to fulfil a purchase, manage your account, or deliver our services. This includes processing orders, issuing order confirmations, and coordinating shipping.
  • Legitimate interests — processing carried out to operate and improve the platform, prevent fraud, conduct basic analytics, and market our services to existing users, where our interests are not overridden by your rights.
  • Legal obligation — processing required to comply with applicable laws, including financial and tax regulations.
  • Consent — processing for marketing communications and non-essential cookies, where we have obtained your explicit consent. You may withdraw consent at any time without affecting the lawfulness of prior processing.

Where we rely on legitimate interests, we have assessed that those interests are proportionate and do not override your fundamental rights and freedoms.

6. Payments and Fraud Prevention

Payments on ArtRewards are processed through Stripe. When you complete a purchase, your payment details are handled directly and securely by Stripe. ArtRewards does not store your full card number, CVV, or equivalent payment credentials on our servers.

Stripe may collect and process data for the purposes of:

  • Authorising and completing your transaction
  • Fraud detection and prevention
  • Compliance with applicable financial regulations

For information on how Stripe handles your payment data, please refer to Stripe's Privacy Policy at https://privacy.stripe.com

We may also use additional fraud-prevention tools that analyse transaction data to identify and block suspicious activity. This processing is based on our legitimate interest in protecting buyers, sellers, and the platform's integrity.

8.1 Types of Cookies We Use
  • Essential cookies are necessary for the website to function and cannot be switched off. They are set in response to actions you take, such as logging in or completing a purchase.
  • Functional cookies allow the site to remember your preferences and settings, such as your language or saved items, to provide a more personalised experience.
  • Analytics cookies collect anonymised information about how visitors interact with the site, including pages visited, session duration, and referral sources. This helps us understand and improve the site.
  • Marketing cookies track your browsing activity to enable relevant advertising and to measure the effectiveness of our promotional campaigns

You may opt out of Google Analytics tracking at https://tools.google.com/dlpage/gaoptout

8.3 Managing Your Cookie Preferences

You can control and manage cookies through your browser settings. Most browsers allow you to refuse new cookies, delete existing cookies, and set preferences for when cookies are placed. Please note that disabling certain cookies may affect the functionality of the ArtRewards website.

Where required by law, we will ask for your consent before placing non-essential cookies. You may update your cookie preferences at any time through our cookie consent settings, which appear when you first visit the site.

9. Third-Party Services

ArtRewards works with a number of trusted third-party providers to operate the platform. These providers may process some of your personal data on our behalf, acting as data processors under our instruction.

We only share the minimum personal data necessary for each provider to perform their function. We require all third-party processors to implement appropriate security measures and to process data solely in accordance with our instructions.

We do not sell your personal data to third parties for their own marketing purposes.

  • Marketing preferences and subscriber data are retained until you unsubscribe or withdraw consent, after which we retain a record of your opt-out status to ensure we do not contact you again.
  • Analytics data is retained in anonymised form and is not subject to a fixed deletion schedule.

When personal data is no longer required, we securely delete it or anonymise it so it can no longer be used to identify you.
